My landlord wants to evict me. What are my rights?+
In Tamil Nadu, a landlord cannot evict a tenant without following the Tamil Nadu Buildings (Lease and Rent Control) Act, 1960. They must give a proper notice period and file a petition in the Rent Control Court — they cannot forcibly remove you or cut off utilities. Valid grounds for eviction include wilful default in rent payment (3+ months), subletting without permission, or the landlord's own genuine need. If your landlord tries to illegally evict you, you can file a complaint at the local police station and approach the Rent Control Court for protection. Always get your rental agreement registered.
Can I get anticipatory bail if I fear arrest?+
Yes. Under Section 482 of the BNSS (formerly Section 438 CrPC), the Madras High Court or Sessions Court can grant anticipatory bail if you have reasonable grounds to believe you may be arrested. You must apply before the arrest happens. The court considers the nature of the accusation, your criminal antecedents, and the likelihood of flight. Conditions like surrender of passport or periodic reporting to police are commonly attached. This protection prevents custodial harassment while your case proceeds. File early — once arrested, you must apply for regular bail.
How long does a property registration take in Tamil Nadu?+
Property registration at a Tamil Nadu Sub-Registrar office typically takes 1–3 working days after booking the appointment online via the TNREGINET portal. The actual registration appointment takes 2–4 hours. Before registration, ensure: Encumbrance Certificate (EC) is clear, property tax is paid up to date, patta/chitta documents are in order, and stamp duty is paid correctly (currently 7% + 4% registration fee in TN). Delays happen when documents are incomplete or title is disputed. Get a lawyer to verify title before you pay any advance.
My employer dismissed me without notice. What can I do?+
Under the Industrial Disputes Act, 1947, an employer cannot terminate a workman without following due process — notice, inquiry, and valid reason. If you are a workman (not a managerial employee), you can file a complaint with the Labour Commissioner within 3 years of dismissal. For managers and senior employees, remedies exist under contract law and courts. You may be entitled to back wages, reinstatement, or compensation depending on how long you worked and the nature of the termination. Collect all employment documents, payslips, and any written communication before approaching a lawyer.
How do I file for divorce in Chennai?+
Divorce petitions in Chennai are filed at the Family Court, Chennai (located at Greenways Road). For Hindus, the Hindu Marriage Act 1955 applies. For Christians, it's the Indian Divorce Act 1869. For Muslims, different personal laws apply. Mutual consent divorce: Both parties agree — takes 6–18 months typically, with a mandatory 6-month cooling-off period (can be waived by court). Contested divorce: Can take 2–5 years depending on the grounds, evidence, and whether custody is disputed. Grounds include cruelty, desertion (2+ years), adultery, and mental disorder. Filing fee is minimal; the bulk of cost is advocate fees and time. Start collecting financial documents and correspondence early.
Someone is cheating me online. Can I file a case?+
Yes. Online fraud is punishable under the IT Act 2000 (Section 66C, 66D) and the Bharatiya Nyaya Sanhita (BNS) 2023. Report immediately to the National Cybercrime Helpline: 1930 or online at cybercrime.gov.in. Also file a complaint at your nearest police station. If the amount is significant, also file a complaint with the Economic Offences Wing, Chennai. Preserve all screenshots, transaction records, email/WhatsApp messages, and website URLs as evidence — these are critical. Courts in India can freeze accounts and order restitution. Act quickly — delay allows the accused to move funds and delete evidence.
What is the time limit to file a legal case (limitation)?+
The Limitation Act, 1963 sets different deadlines for different cases. Key ones: Money recovery suits: 3 years from when the money was due. Property suits: 12 years for possession, 30 years for government land. Cheque bounce (NI Act): 30 days to send legal notice, file within 1 month of notice period expiry. Consumer complaints: 2 years from cause of action (now extended under Consumer Protection Act 2019). Criminal matters: FIRs for cognisable offences have no time bar. Missing the limitation period usually means your case is dismissed outright — approach a lawyer as soon as a legal dispute arises.
Can I challenge a GST demand notice?+
Yes. If you receive a GST show-cause notice or demand order, you have the right to reply and be heard before any recovery is made. The GST hierarchy for appeals is: 1. Adjudicating Authority → 2. First Appellate Authority (90 days) → 3. GST Appellate Tribunal → 4. High Court → 5. Supreme Court. For demand orders, appeal must be filed within 3 months. You must deposit 10% of the disputed tax amount as pre-deposit for the first appeal. Time limits are strict — do not ignore a GST notice hoping it will go away. Failure to respond results in ex-parte orders and recovery proceedings including bank attachment.
